چکیده
برای دورههای میانه و معاصر در حوزه اندیشه میتوان مقوماتی برشمرد. در دوره میانه با توجه به ملغمه پیچیدهای از آموزههای کلیسا و سنتهای باقیمانده از امپراطوری روم غربی، آسمان و دین در رابطهای طولی، بالاسر زمین و عقل قرار دارد. همین رابطه یکسویه است که دوران میانه را به دوران «تکمنبعی بودن» معرفت متصف میکند و نظامات اندیشهای را ذیل وحی و دین قرار میدهد. دوره معاصر، اما، دوران تکثر منابع معرفتی و چرخشهای بزرگ از دوران میانه است. بر اساس چنین تفکیکی، سوال اساسی مقاله حاضر این است که نسبت سنجه عقلانیت قدرت و تطور تاریخی آن با اندیشه و نظم حقوقی (با تاکید بر دوره میانه و جدید) چیست؟ بنابرفرض، براساس الهیات سیاسی دوران میانه، عقلانیت قدرت منشایی الهی داشته و «تکمولفهای» بوده است و در دوران معاصر با توجه به ویژگیهای گفتمانی، این عقلانیت متنوع و چندپاره بوده و اندیشه و نظم حقوقی خاص خود را به دنبال دارد. دستاورد پژوهش حاضر، تببین نحوه درونیشدن هنجارهای حقوقی از طریق تناسب آن با عقلانیت حاکم بر جامعه و حداقلی و یا کاراترشدن ضمانت اجراهای آن است. پژوهش حاضر با استفاده از روش گردآوری اسنادی و کتابخانهای و تحلیل اطلاعات بهدست آمده براساس روش تحلیلی نگاشته شده است.

The relationship between the rationality of power and legal thought from the perspective of medieval and contemporary philosophers

One can enumerate some constituents for the so-called middle and contemporary periods in the field of thought. In the middle period, heaven and religion are in a longitudinal relationship, above the earth and intellect. This unidirectional relationship characterizes the Middle Ages as the era of "single source" knowledge and places all the thought systems under the revelation. The contemporary period, however, is the era of pluralization of epistemic sources and emergence of other types of relationships between thought systems; An era in which the longitudinal relationship between revelation and reason is faced with era-making questions and the gates of the multi-source era in the field of thought and politics are opened. It is based on this distinction that in this article, the issue of the rationality of power, as a measure, in the middle and contemporary period and its impact on legal thought has been investigated. The most important achievement of such a theoretical effort is the internalization of legal norms due to its compatibility with the rationality of the society and making the execution mandate aimed at it more efficient. Legal thought and order which is in a dialectical relationship with the rationality of the power of each era, plays a more effective role in social ordering.
