The increase in the number of UN member states from 51 in 1945 to 149 in 1984 was largely due to decolonization. While colonizers would refer to colonies as part of their own territories and refuse to grant them independence for a long time, from the late 1950s, the UN began to take important measures to accelerate the process of decolonization. This led to the adoption of UN resolution 1514 of December 1960, which recognized the right to self-determination of colonies as a binding rule in the international legal system. The main question of this article is, what processes transformed decolonization from a political ideal into a legal norm? As descriptive research, the present study used library and Internet resources. The analysis of the decolonization process shows that despite the resistance of colonizing states and the failure to include the right of colonies to attain independence in the UN Charter, the right to self-determination of colonies has become an imperative rule in international law owing to liberation movements as well as the support from socialist and the Third World states in the UN General Assembly. As a result, decolonization has been considered one of the most important ways of establishing new states in the international arena.}, keywords = {Decolonization,Establishment of States,Colonizing States,Trusteeship Council,UN General Assembly}, title_fa = {روند استعمارزدایی از منظر حقوق بین‌الملل}, abstract_fa = {استعمارزدایی به عنوان یکی از اشکال تشکیل دولت‌های مستقل، یکی از پدیده‌های مهم قرن بیستم بوده است، هرچند ریشه‌های آن را می‌توان در قرن نوزدهم نیز دید. افزایش تعداد دول عضو سازمان ملل متحد از 51 دولت در سال 1945 به 149 دولت در سال 1984 عمدتا ناشی از استعمارزدایی بود. در حالیکه استعمارگران از سرزمینهای مستعمره به عنوان بخشی از سرزمین خود نام می‌بردند و تا مدتها از اعطای استقلال به آنها خودداری می‌کردند اما از اواخر دهه 1950 میلادی شاهد اقدامات مهم سازمان ملل متحد جهت تسریع روند استعمارزدایی بودیم تا آنکه با تصویب قطعنامه مهم شماره 1514 در دسامبر 1960، شناسایی حق تعیین سرنوشت مستعمرات به قاعده ای الزام آور در نظام حقوق بین‌الملل تبدیل شد. پرسش اصلی این مقاله آن است که استعمارزدایی طی چه فرایندی از آرمانی سیاسی به هنجاری حقوقی مبدل شد؟ تحقیق حاضر به روش توصیفی و با استفاده از منابع کتابخانه‌ای و اینترنتی نگاشته شده است. تحلیل روند استعمارزدایی نشان می‌دهد که علی رغم مقاومت دول استعمارگر و عدم درج حق مستعمرات به تحصیل استقلال در منشور ملل متحد، در نتیجه پایمردی جنبشهای آزادیبخش و حمایت دولت‌های سوسیالیستی و جهان سوم در مجمع عمومی سازمان ملل متحد، حق تعیین سرنوشت خارجی مستعمرات در حال حاضر به یکی از قواعد آمره حقوق بین‌الملل تبدیل شده و استعمارزدایی یکی از مهمترین شیوه‌های تاسیس دولت‌های جدید در عرصه بین‌المللی بوده است.}, keywords_fa = {استعمارزدایی,تاسیس دولت,دول استعمارگر,شورای قیمومت,مجمع عمومی ملل متحد}, url = {https://tssq.atu.ac.ir/article_13381.html}, eprint = {https://tssq.atu.ac.ir/article_13381_487408dc4f11f317ab625216c21e2319.pdf} }
