Palestine’s recognition by the United Nations led to its accession to various conventions on human rights and humanitarian law. Rome Statute 1998 – the constitutive act of the International Criminal Court – was one of the important documents to which  Palestine joined while it made a declaration indicating the admission of the jurisdiction of the Court. Palestine’s joinder to this document provided the possibility of prosecution and trial of the perpetrators of crimes committed under the Court's jurisdiction at the Palestinian territory and against its subjests. The Court's prosecutor is making the preliminary examinations and investigations to find out whether there is the Court’s jurisdiction and a reasonable basis in accordance with the articles of the statute in order to initiate the proceedings. The main question of the present research is on the manner of Palestine’s recognition as a state and the effects associated with its joinder to the International Criminal Court. The most imporstant effect of such joinder is the possibility of referring a situation by the state to the ICC. In this essay, an attempt is made to study the results caused by referring a situation to the Court. Israel will face a cooperation demand but we should not be too optimistic about its cooperation.}, keywords = {Palestine,Israel,the International Criminal Court,competence,cooperation}, title_fa = {از شناسایی دولت فلسطین تا عضویت در دیوان کیفری بین‌المللی}, abstract_fa = {عاقبت بعد از فراز و نشیب­های فراوان سازمان ملل متحد، فلسطین را به‌عنوان «دولت غیر عضو ناظر» در این سازمان به‌رسمیت شناخت. شناسایی این وضعیت برای فلسطین موجب شد تا این دولت درخواست الحاق به کنوانسیون‌های مختلفی در زمینه حقوق بشر و حقوق بشردوستانه بدهد. اساسنامه رم 1998 ـ که سند تاسیس دیوان کیفری بین‌المللی است ـ یکی از اسناد مهمی بود که فلسطین ضمن الحاق به آن اعلامیه­ای مبنی بر پذیرش صلاحیت آن دیوان تقدیم کرد. الحاق فلسطین به این سند امکان تعقیب و محاکمه مرتکبین جنایات تحت صلاحیت دیوان را که در سرزمین فلسطین و علیه اتباع آن کشور صورت گرفته را فراهم می­کند. دادستان دیوان مشغول بررسی و تحقیقات اولیه است تا در صورت وجود صلاحیت و مبنای معقول مطابق با اساسنامه به اعمال ارتکابی اسرائیل رسیدگی کند. پرسش اصلی این تحقیق مربوط به نحوه شناسایی فلسطین به‌عنوان دولت و آثار مترتب بر الحاق این دولت به دیوان کیفری بین‌المللی است. مهم‌ترین اثر الحاق مزبور، امکان ارجاع وضعیت توسط آن دولت به دیوان است. در این مقاله، تلاش می­شود تا امکان‌سنجی نتایج حاصل از ارجاع وضعیت به دیوان مورد بررسی قرار گیرد. با تحلیل موضوع در پرتو مقررات اساسنامه دیوان کیفری به این نتیجه می­رسیم که امکان اعتراض به صلاحیت دیوان از طرف اسرائیل خیلی محتمل است و در ضمن از آن‌جا که اسرائیل عضو دیوان نمی‌باشد و یقیناً این محکمه به‌منظور انجام تحقیقات با مشکلات فراوانی روبرو خواهد بود که همکاری اسرائیل را می­طلبد اما نمی­توان به این همکاری زیاد خوشبین بود. }, keywords_fa = {فلسطین,اسرائیل,دیوان کیفری بین‌المللی,صلاحیت,همکاری}, url = {https://tssq.atu.ac.ir/article_6777.html}, eprint = {https://tssq.atu.ac.ir/article_6777_adba39932b3110d9d17ebee3608b5fd5.pdf} }
